Terms of Service

Welcome to Oddstamps (the "Service"), operated by Oddstamps, a business based in Ontario, Canada ("we," "us," or "our"). By accessing, registering for, or using our Service, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use or access the Service. Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy, which is incorporated into these Terms by reference.

1. Geographic Restrictions & Service Availability

• Restricted Access: This Service is intended for and restricted strictly to residents of the United States and Canada (specifically excluding the Province of Quebec) (the "Permitted Territories"). The Service is not offered or directed to individuals residing in the Province of Quebec, the European Union (EU), the European Economic Area (EEA), the United Kingdom, China, or any other jurisdiction outside the Permitted Territories. By registering for an account, you affirmatively represent and warrant that you are not physically located in, and do not reside in, the Province of Quebec.
• Language of Service & Exclusion of Quebec: The Service, including its web interface, features, customer support, and legal terms, is operated exclusively in the English language. In compliance with local language regulations (including Quebec's Charter of the French Language, Bill 96), residents of the Province of Quebec are not eligible to register an account or use the Service.
• Geolocking & Prohibition on Circumvention: We utilize geographic filtering ("geolocking") technologies at the network edge to block access from outside the Permitted Territories. You agree not to bypass, circumvent, or attempt to bypass or circumvent any such geolocking measures (including through the use of virtual private networks (VPNs), proxy servers, or other location-masking tools) to access the Service from a prohibited region or jurisdiction.
• No Representation: We make no representation that the Service is appropriate, lawful, or available for use outside the Permitted Territories. Accessing the Service from territories where its contents or language are unlawful or unauthorized is strictly prohibited.

2. Description of Service & Beta / Rapid Evolution Notice

• Description of Service: The Service provides web-based tools that allow users to upload scans of stamp sheets or physical philatelic items, isolate and crop individual stamps using automated computer vision tools (including machine learning models), organize digitized assets into albums or catalogs, and save them privately or share them publicly via our domain.
• Beta / Public Preview Status: The Service is currently deployed as a pre-release, beta, or public preview product. It is under active, continuous, and rapid engineering development.
• Unilateral Right to Modify & Redesign: We reserve the absolute, unfettered right to modify, update, redesign, restructure, suspend, limit, or discontinue any feature, user interface, tool, visual layout, data structure, processing pipeline, or aspect of the Service at any time, with or without prior notice, and without liability to you or any third party.
• No Expectation of Permanence: You expressly acknowledge and agree that the website and Service may change significantly in appearance, functionality, workflow, and availability in the coming days and weeks. You have no vested right or reasonable expectation that any specific feature, layout, tool, design element, or behavior will remain available or functional.
• Telemetry & Diagnostic Monitoring: You acknowledge and agree that the Service utilizes automated telemetry, performance monitoring, and error diagnostics to track application health, diagnose software errors, and ensure platform security and stability.

3. Eligibility & Account Registration

• Age: You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher) to access or use the Service. If you are between 13 and the age of majority in your jurisdiction of residence, you may only use the Service if your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Account Security: Authentication is handled via our third-party identity providers. You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

4. User Content & License Grants

• Ownership: You retain all copyright and proprietary ownership rights in the original images, scans, text, tags, notes, and other data you submit to the Service ("User Content").
• License to Oddstamps: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, modify, crop, resize, analyze, transmit, format, and display your User Content solely to operate, improve, and provide the Service (e.g., executing crop pipelines, storing assets in our cloud object storage, indexing collection records in our database, and rendering your digital albums). This license does not permit us to use your User Content to train, fine-tune, or improve machine learning models.
• No Foundation Model Training: We do NOT sell your User Content. Images sent to our AI providers are processed transiently to return results to us. We do not use your User Content to train, fine-tune, or improve any machine learning models. If we ever introduce a model improvement program, participation will be strictly opt-in, as described in our Privacy Policy.
• Third-Party Inference: To perform automated cropping, matching, and descriptive suggestions, we transmit User Content transiently to specialized third-party serverless inference providers (including our third-party machine learning infrastructure for image segmentation, text, and feature extraction) strictly for real-time processing.
• Your Representations: You represent and warrant that you either own the copyright in your User Content, possess the lawful right to scan and reproduce the physical items under applicable statutory exemptions (such as fair dealing in Canada or fair use in the United States for personal, indexing, or collector purposes), or have obtained all necessary permissions.
• Cropping Tools & Bounding Boxes: You maintain sole control and discretion over bounding boxes created using our automated or manual cropping tools. Any visual data, text, postmarks, or addresses you choose to select within a crop boundary remain your User Content. You agree not to use manual cropping tools to isolate, capture, or publicly distribute unredacted third-party personal, financial, or confidential information.
• Service Outputs: Oddstamps grants you a personal, non-exclusive license to view and download the cropped images and AI-generated metadata produced by the Service for your personal or commercial philatelic use. However, Oddstamps retains all right, title, and interest in and to any proprietary models, system prompts, segmentation masks, and underlying database schemas.

5. Public Sharing & Visibility

• Visibility Controls & Propagation Window: By default, your uploaded stamp collections are set to "Private." If you explicitly designate an album or collection as "Public," you grant us the right to make that collection and its associated stamp images and metadata visible and accessible to anyone on the internet via our domain. If you toggle a public collection or stamp back to "Private," our API will immediately restrict unauthorized direct access to that record. Please note that due to the architecture of distributed edge networks and asynchronous background queues, it may take up to forty-eight (48) hours for cached image assets, CDN edge nodes, and vector search indices to fully propagate and invalidate across our global infrastructure.
• User Responsibility for Public Content: You are solely responsible for all User Content you make public. We assume no responsibility or liability for third-party copying, downloading, distribution, or use of content you voluntarily make publicly accessible.
• Published Binder Templates: When you publish a binder template, you authorize us to use its layout, slot details, and image fingerprints derived from its stamps (embeddings) to help other users match stamps from their own collections to it. Other users never receive your private stamps or the fingerprints themselves. Matching features may be subject to usage limits or paid plans, and publishing a template does not entitle you to any payment.
• Third-Party Crawlers and Caching: While a collection is designated as "Public," it may be crawled, cached, or indexed by external search engines, automated web spiders, or public web archives. Oddstamps does not control, and cannot remove content from, third-party search engines or external caches that indexed your content while it was publicly accessible.

6. Prohibited Conduct & Platform Integrity

You agree that you will not, under any circumstances:

• Upload unredacted images of modern postal mail or correspondence containing the private, financial, or identifying data of third parties without their express consent.
• Enter, submit, or transmit any sensitive personal data (such as government-issued identification numbers, passwords, financial account credentials, or confidential third-party secrets) into freeform AI prompts, catalog fields, or collection notes.
• Upload, share, or transmit any content that is illegal, defamatory, abusive, obscene, pornographic, harassing, fraudulent, or that infringes any intellectual property or privacy rights.
• Use the Service, its automated segmentation tools, or high-resolution outputs to forge, counterfeit, alter, reproduce, or clean postage stamps or postal markings for fraudulent mailing, postage reuse, or in violation of Canada Post Corporation regulations, the United States Postal Service rules, or applicable criminal statutes.
• Attempt to probe, scan, exploit, reverse engineer, decompile, disable, or disrupt the Service's infrastructure, source code, edge workers, databases, cloud object stores, or AI inference endpoints.
• Use any automated means (such as scrapers, spiders, bots, or automated scripts) to harvest data, flood queues, or artificially inflate usage or inference requests.
• Bypass, circumvent, or tamper with any authentication, geolocking, rate limiting, or security measures.
• Create multiple accounts, puppet profiles, or utilize automated identity cycling to evade account-level quotas, monthly vector indexing limits, or platform rate limiters.
• Use the Service to facilitate, document, or promote any commercial transaction or transfer of physical goods that violates Canadian export controls, the Special Economic Measures Act (SEMA), or United States sanctions administered by the Office of Foreign Assets Control (OFAC).

7. Complimentary Access, Suspended Billing & Future Monetization

• Complimentary Free Preview: The Service is currently made available 100% free of charge on a complimentary, preview, or beta access basis ("Free Access").
• Suspension of Payment Processing: All payment processing, subscription billing, and paid tiers (including any legacy interface references to "Collector Pro", scan packages, or Stripe billing) are currently suspended, deactivated, or in development mode. We do not collect payment card information, charge subscription fees, or process financial transactions at this time.
• No Consideration & Sole Remedy: Because this Service is provided entirely free of monetary charges during this preview, you agree that your access to the Service constitutes adequate, legal, and sufficient mutual consideration for the licenses, waivers, and limitations set forth in these Terms. Your sole and exclusive remedy for any defect, software bug, platform modification, data loss, UI redesign, downtime, or dissatisfaction is to immediately cease using the Service.
• Reservation of Future Monetization Rights: We expressly reserve the right, at our sole discretion, to introduce paid tiers, subscription plans, fees, feature gates, scan quotas, or processing allowances at any time in the future. In the event we introduce paid plans, you will receive advance notice before any fees would apply to your account, and you will have the choice to subscribe or discontinue use. You acknowledge that free access during this preview period does not grant you any vested, permanent, or irrevocable rights to perpetual free service.
• Quota & Resource Limits: We reserve the right to establish, modify, enforce, or adjust usage quotas, rate limits, storage allowances, and AI inference limits at any time to preserve system stability and control serverless compute costs.

8. AI Tools & Philatelic Disclaimer

The Service utilizes machine learning and artificial intelligence models (such as computer vision and large language models) to automate stamp boundary cropping and suggest descriptive details (such as country of origin, estimated issue year, denomination, and visual descriptions).

• Probabilistic & Informational Nature: Automated crops, visual extractions, and AI-generated metadata are inherently probabilistic and are provided strictly on an "AS-IS" basis for personal organization, novelty, and convenience only. We make no warranty or representation as to their accuracy, completeness, or reliability.
• NO Philatelic Appraisal, Grading, or Certification: Oddstamps is purely a software productivity tool. We do NOT provide professional or official philatelic appraisals, certificates of authenticity, expert condition grading (including mint never hinged, centering, soundness, hinge status, or gum condition), or verified catalog attributions (such as Scott, Stanley Gibbons, Michel, or Yvert & Tellier numbers).
• Proprietary Catalog Numbering Systems: Oddstamps is independent and is not affiliated with, endorsed by, or licensed by Amos Media Company (Scott), Stanley Gibbons Limited, Schwaneberger Verlag GmbH (Michel), or any other catalog publisher. The Service is designed not to generate, reproduce, or display catalog numbers from any proprietary catalog. Any such references a user enters are that user's User Content and do not imply affiliation with, or authorization from, the respective rights holders.
• ZERO Financial or Transactional Liability: Any identification, description, or metadata presented on or generated by the Service is completely non-authoritative. Oddstamps disclaims any and all liability for any purchases, sales, trades, insurance claims, auction bids, estate appraisals, tax filings, or financial transactions undertaken in reliance on information generated, displayed, or suggested by the Service.

9. Non-Archival Service, Cloud Storage & Backup Obligation

• NOT an Archival or Backup Vault: While we utilize cloud object storage and distributed databases engineered for high availability, Oddstamps is NOT a disaster recovery, data backup, or archival storage service. You are strictly and exclusively responsible for maintaining your own independent, offline, and secure backups of all original scan sheets, high-resolution images, and collection records.
• Immunity from Data Loss: Given the rapid and continuous updates occurring across the Service, database schemas and storage structures may undergo changes. To the maximum extent permitted by law, Oddstamps shall have no liability whatsoever for any corruption, loss, accidental deletion, or inability to access or retrieve any User Content, scans, crops, or catalog records.
• Inactive & Abandoned Accounts: We reserve the right to permanently delete raw scan sheets that were uploaded but never cataloged, and raw source scans associated with free accounts that have been inactive for more than twelve (12) consecutive months.

10. Copyright & Takedown Policy (DMCA / Notice-and-Notice)

We respect intellectual property rights and comply with both the United States Digital Millennium Copyright Act ("DMCA") and the Canadian Copyright Modernization Act (Notice-and-Notice regime). If you believe that any public User Content hosted on our domain infringes upon your copyright or proprietary rights, please submit a formal notification to our Designated Copyright Agent containing the following information:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and its exact URL or location on our Service.
4. Your address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Online & In-App Takedown Requests: In addition to email and physical mail, registered users and rights holders may report suspected copyright infringement directly via the Turnstile-verified "Report" option available on public items and album showcases.

Counter-Notice: If you believe your content was removed by mistake or misidentification, you may submit a Counter-Notice to our Designated Agent containing your physical/electronic signature, your name, address, and telephone number, identification of the removed material, a statement under penalty of perjury that the removal was a mistake, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or Toronto, Ontario if outside the US), and that you will accept service of process from the person who provided the original notification.

Canadian Notice-and-Notice: For users and claims originating in Canada, we act as a location tool provider. Upon receiving a compliant notice of claimed infringement, we will forward the notice electronically to the user who posted the content and retain records as required by the Copyright Act.

Repeat Infringers: In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Oddstamps, its founder, officers, directors, contractors, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorney's fees and legal costs) arising out of or relating to:

• Your access to or use of the Service;
• Any User Content you upload, process, save, crop, or publicly share;
• Your violation of any provision of these Terms;
• Your violation of any third-party right, including any intellectual property, privacy, or publicity right;
• Your circumvention of any geoblocking, network filtering, or security controls; or
• Your violation of any applicable federal, provincial, state, or international law or regulation.

We reserve the right, in our sole discretion and without liability or prior notice, to suspend, terminate, restrict, or delete your account, remove or purge any User Content, and block your IP address or access to the Service at any time, for any reason (including for violation of these Terms, suspected automated abuse, excessive resource consumption, or business discontinuation).

14. Governing Law, Jurisdiction & Dispute Resolution

• Governing Law: These Terms and any dispute arising out of or related to them shall be governed by, and construed in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
• Exclusive Jurisdiction: You irrevocably submit to the exclusive personal and subject-matter jurisdiction of the courts situated in the City of Toronto, Ontario, Canada for the resolution of any dispute or lawsuit arising under these Terms.
• Mandatory Informal Resolution: Before initiating any formal legal proceeding, you agree to contact us at support@oddstamps.com and provide a brief written description of your dispute. You and Oddstamps agree to attempt in good faith to resolve the dispute informally for at least thirty (30) days prior to commencing any formal litigation.

15. Entire Agreement, Severability & Changes to Terms

• Modifications to Terms: We may update or amend these Terms at any time. If we make material changes, we will notify you via email or a prominent notice on the Service prior to the changes taking effect, and we will update the "Last Updated" date at the top of this page. Your continued use of the Service following the effective date of any update constitutes your binding acceptance of the revised Terms.
• Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary, and all remaining provisions of these Terms shall remain in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and Oddstamps regarding your use of the Service, superseding all prior oral or written agreements, understandings, or representations.

16. Language of Agreement

These Terms of Service, along with all incorporated policies, guidelines, notices, and communications, are established, interpreted, and executed exclusively in the English language. The parties confirm their express wish that these Terms of Service and all related documents be drawn up exclusively in the English language. / Les parties confirment leur volonté expresse que les présentes modalités de service et tous les documents s'y rattachant soient rédigés exclusivement en langue anglaise.

17. Feedback & Suggestions

If you send us feedback, bug reports, feature requests, or suggestions ("Feedback"), you agree that Oddstamps is free to use, modify, exploit, and incorporate that Feedback into the Service unconditionally, without any payment, attribution, or legal obligation to you.
